ORDINANCE NO. 7, 1994

ORDINANCE CONCERNING DISPOSITION OF REFUSE

BE IT HEREBY ORDAINED BY THE COUNCIL OF THE TOWN OF BROOKSTON, INDIANA, AS FOLLOWS:

Section 1.

No person shall throw or deposit refuse or litter of any kind upon any street, alley, sidewalk or any other public place, or upon any privately owned lot within the Town of Brookston, whether owned by that person or not.

Section 2.

Any person who permits refuse or litter to be collected for disposal within the Town of Brookston, whether by private contract or municipally provided, shall provide and maintain adequate receptacles for collection of such refuse or litter in such a manner that any and all of such refuse or litter will be prevented from being carried or deposited by animals or the elements upon streets, alley, sidewalks, or other public places, or upon any private property. No person shall deposit such refuse or litter outside their home to be collected for disposal within the Town of Brookston for longer than twenty-four (24) hours in advance of such collection.

Section 3.

Every owner or agent of the owner of every multiple dwelling or mobile home park shall provide and at all times maintain trash receptacles in sufficient number to contain the accumulation of refuse and litter deposited for collection by the Residents of such multiple dwelling or mobile home park in the manner required by Section 2 of this Ordinance. Further, every owner or agent of the owner of every trailer court, or multiple dwelling occupied by three (3) or more families, shall completely enclose from public view all such trash receptacles required by this Ordinance.

Section 4.

Any person who violates any provision of this Ordinance shall be subject to a civil penalty of Twenty-five dollars ($25.00) for a first violation thereof, and Fifty Dollars ($50.00) for any second or subsequent violation of this Ordinance committed within one (1) year of any prior violation of this Ordinance.

Section 5.

This Ordinance shall repeal all other ordinances in conflict herewith and shall be in full force and effect from and after its passage, adoption and publication as may be required by law. SO ORDAINED by the Council of the Town of Brookston, Indiana, on this 22nd day of November, 1994.
