ORDINANCE NO. 5-1963

An Ordinance Regulating Garbage, Rubbish, Noxious Weeds and other Nuisances and Prescribing Penalties Therefore.

BE IT ORDAINED BY THE TOWN BOARD OF TRUSTEES OF THE TOWN OF BROOKSTON, INDIANA:

Section 1

It shall be unlawful for any person owning or in possession of real estate within the corporate limits of said Town to allow or permit to grow thereon any rank or noxious weeds.

Section 2.

Such weeds shall be cut and hauled away at any time upon written order of the Town Marshall. The Town Marshall shall fix a reasonable time limit of not more than five days said written order.

Section 3.

It shall be unlawful for any person owning or in possession of real estate within the corporate limits of said Town, to allow or permit garbage, rubbish, or junk to accumulate thereon.

Section 4.

Such garbage, rubbish and junk shall be hauled away at any time upon the written order of the Town Marshall. The Town Marshall shall fix a reasonable time limit of not more than five days in said written order.

Section 5.

It shall be unlawful and deemed to be a nuisance for any person owning or in possession of real estate within the corporate limits of said Town, to allow or permit to remain standing thereon any structure which shall have been damaged by fire, windstor m, or otherwise which is in such a state of disrepair that it is not enclosed as to keep out the elements or that it becomes a place where rodents accumulate.

Section 6.

Such structures shall be hauled away at any time upon the written order of the Town Marshall, The Town Marshall shall fix a reasonable time limit of not more than thirty days in said written order.

Section 7.

If any such owner or person in possession of such real estate after having been duly ordered as provided herein, shall fail or refuse to obey such order, it shall be the duty of the Town Board of Trustees to cause the work to be done to abate such cond ition. The expense thereof shall be a municipal lien on the property and collected by being placed upon the tax duplicates and turned into the Town General Fund.

Section 8

All ordinances or parts thereof in conflict herewith are hereby repealed.

Section 9.

This Ordinance shall be in full force and effect from and after its passage and signing by the President of the Board of Trustees.

Passed and adopted by the Town Board of Trustees of the Town of Brookston, Indiana on the 12th day of August, 1963 at the hour of 8:00 P.M.
